Opinion Exchange with SIPO Utility Model Delegation

On December 1, 2017, JIPA held an opinion exchange meeting with a 5-member utility model delegation led by Mr. Qu, Chief of Examination Department, of the State Intellectual Property Office of China (SIPO) at JPO. A total of 12 JIPA members from the Asian Strategic PJ East Asia WG, the International Third Committee, and the secretariat attended the meeting.
In this meeting, JIPA introduced its activities, and held a question and answer session about "substantial examination," "efforts to improve the quality of examination," procedures for "PCT international applications entering the Chinese national phase," etc., with regard to utility model applications. We obtained useful information on the ongoing revision of the Patent Law and a possible revision of related rules associated with the ongoing revision.

The participants also had a lively discussion on examination practice including "use of technical opinions on patent right" and "protection of right using both patent and utility model."
