JIPA Representatives¡Ç visit to Indonesia

¡¡From January 14 to 18, 2018, Southeast Asia WG, Asia Project of JIPA sent a 6 member representative delegation led by Vice President Mr. Bekku (Nissan) to the following 6 Indonesian IP-related organizations, and made proposals and requests for improvement in IP-related issues in Indonesia raised by JIPA members. The delegation to Indonesia has been conducted for the second consecutive years, since many JIPA members were interested in the country according to the survey.

¡¡Directorate General of Intellectual Property (DGIP), Customs, Supreme Court, National Police, Indonesian Association of Intellectual Property Consultant (Asosiasi Konsultan Hak Kekayaan Intelektual(AKHKI)), Indonesia Anti-Counterfeiting Society(Masyarakat Indonesia Anti Pemalsuan(MIAP))

¡¡ In the DGIP, we had a meeting in all of the Directorate of Patent, the Directorate of Trademark, and the Directorate of Investigation and Dispute Settlement, with the support of the Directorate of Cooperation & IP Empowerment. The delegation submitted requests and exchanged opinions with them on ¡Èprompt patent examination,¡É ¡Èrelaxation of obligatory practice of invention,¡É ¡Ècareful operation of compulsory license of patent right,¡É ¡Èpublication of examination guidelines,¡É ¡Èproposed revision of the Design law and its schedule,¡É ¡Èenhanced and prompt control of goods infringing intellectual property rights,¡É ¡Èclarification of right holder¡Çs cost incurred in the control of infringing goods,¡É etc.

¡¡In the Customs, the delegation submitted requests and exchanged opinions with officials on details and schedules of the operation of the control, or suspension of goods infringing intellectual property rights in the Customs, which will soon be coming into force.

¡¡In the National Police, the delegation submitted requests and exchanged opinions on ¡Èenhanced and prompt control of goods infringing intellectual property rights,¡É ¡Èclarification of right holder¡Çs cost incurred in the control of infringing goods,¡É etc.

¡¡ In the Supreme Court, the delegation submitted requests and exchanged opinions on "making the availability of provisional measures well-known," "improved consistency of judgements," "review of original-first policy related to evidence", "prompt service of decisions," etc.

¡¡ In Asosiasi Konsultan Hak Kekayaan Intelektual (AKHKI) and MIAP, we frankly exchanged views and information about actual situations of the control of goods infringing intellectual property rights and planned revision of the law.
We also agreed to keep friendly relationship with each other in the future.

¡¡Although some of our requests have been reflected on Indonesian laws and systems and their operation, many improvements are still necessary for right holders. In this visit the delegation again realized that continued transmission of our request was necessary with timely exchange of views and offering of information.
