FY2015 Delegation to China

The Asia PJ East Asia WG sent a six-person delegation to Beijing, China from March 15 to 18, 2016. They had meetings to exchange opinions with the Legislative Affairs Office of the State Council, the State Intellectual Property Office (SIPO), the Ministry of Commerce, JETRO Beijing, and local patent law firms.

During these meetings, JIPA asked questions about the Patents Law, Copyright Law, and Anti-Unfair Competition Law (all of which are currently undergoing amendment), as well as the Foreign Investment Law and the Employee Service Inventions Regulation, etc. (which are currently being enacted). The questions related mainly to the progress of the work being done by each relevant department and the background to the establishment and amendment of the respective laws. JIPA also expressed its opinions.
The Legislative Affairs Office of the State Council did not specify exactly when these laws, etc. would be amended or established because many issues remain that must be examined. They stated that they would convey JIPA's opinions to the SIPO for further examination. At the meeting with the Ministry of Commerce, JIPA expressed its concerns regarding the Technology Import-Export Regulations and requested a review on the occasion of the next amendment.

The JIPA delegation was this time able to directly exchange opinions with the Legislative Affairs Office of the State Council, which had not been possible for several years, and reestablished an important conduit for JIPA's opinions. Forming a connection with the Legislative Affairs Office of the State Council was one of the achievements of this delegation.
