JIPA send a delegation especially for Chinese patent law administrative instruction revision
JIPA strategy to Asian countries PJ goes to Beijing, China from 2nd to 8th December,2007.
The missions of this delegation are as follows;
- To monitor the progress of amendment of Chinese Patent Law at The Legislative Affairs Office
- To make request to State Intellectual Property Office on administrative instruction and examination instruction which will be revised after the Patent laws revision
- To preformulate judicial interpretation of above mentioned administrative instruction and examination instruction at Supreme Court
- To exchange opinions at IP center of Academy of Social Science on future IP system in China
The delegation also visit the our counterpart, Patent Protection Association of China (PPAC), All China Patent Agents Association (ACPAA), and two patent law offices to exchange views on common IP problems.
In planning for this mission, PJ members organized and integrated the Chinese IP problems which were collected from JIPA member companies. Though the problems were so many and miscellaneous, each offices explained at length and this made the meetings more than satisfactory.
They are sure that all destinations will consider the problems in written form as well as the agendas we discussed directly. The limited time avoid us talking enough on the progress of Chinese Patent Law revision and Amendment of Instructions go along with the patent law revision, and preformulate of judicial interpretation.
The end of the mission, They visited JETRO Beijing Office and talked with Beijing IP Group members on the result of this mission. They confirm that JIPA and IPG cooperate continuously to the series of Chinese law revision.
The Chinese law revision seems to behind schedule though, the delegation members got a feel for the reform bill would pass the National People's Congress by the end of 2009 at the latest. Anyway the year 2008 must be the year IP related person cannot keep their eyes off the series of Chinese law revision.
